The LSSI-CE is the Law on Information Society Services and Electronic Commerce.
The growth we've seen in recent years in the various online transactions we've conducted has made it necessary to establish a legal framework that builds trust in the activities carried out within this new medium.
In this sense, the LSSI-CE establishes the rules and regulations necessary to ensure that commercial activities on the Internet are a safe and honest experience for all users who wish to benefit from them.
According to the LSSI-CE, specifically in Article 10, it is specified what information every web platform must have in an area that is accessible and visible to the user:
- Contact information, NIF, name or social identification.
- Be registered in the Commercial Registry or any public registry that certifies that it is a legal entity.
- You must inform us if there is any type of tax on the product price, whether it is included or not, and whether shipping costs are included.
- If it is a regulated activity, the license number, academic qualification, where it was issued, and its approval must be indicated.
- If the web platform uses cookies, it must inform the consumer about their purpose and use, and give them the option to uninstall them if required.
Failure to disclose all of this information could result in a fine of up to €30,000, as this would be considered a minor offense. However, if such concealment had any negative impact on consumers or the market, the fine could rise to €150,000, as this would constitute a serious offense.
Ultimately, we must be mindful of all the regulations and laws that govern all online activities if we don't want to be caught off guard by sanctions.
